Terms & Conditions

These Terms & Conditions are an agreement between you and Vivitec.AI ("Vivitec", "we", "us") covering vivitec.ai and the services offered through it. By using the site, submitting a form, or purchasing a plan, you accept these terms. If you do not agree, do not use the site.

If you accept on behalf of an organization, you confirm you have authority to bind that organization.

Vivitec provides AI advisory, security, enablement, and implementation services. The website describes those services, lets you configure and request a plan, and lets you contact us. A submitted request is not a contract; work begins only when we both agree on scope in writing.

• Prices shown during plan configuration are the prices in effect at the time of purchase and may change for future purchases.
• Payments are processed by Stripe. By purchasing, you also accept Stripe’s terms and authorize the charge shown at checkout.
• Recurring plans renew automatically for successive terms at the then-current rate until cancelled.
• You may cancel a recurring plan at any time; cancellation stops future renewals and takes effect at the end of the paid term.
• Fees already paid are non-refundable except where required by law or expressly agreed in writing.
• You are responsible for any applicable taxes not collected at checkout.

By giving us your mobile number and opting in — through a form on this site, a written request, or consent captured during a call or consultation — you agree to receive SMS messages from Vivitec.AI at that number. Opting in is voluntary and is not a condition of purchasing any product or service.

• Messages may include responses to your inquiries, appointment and consultation scheduling, confirmations, reminders, service updates, follow-ups, and account or project-related information consistent with the consent you gave.
• Message frequency varies with your inquiry, your engagement, and the scheduling activity on your account.
• Message and data rates may apply. Those rates are set by your wireless carrier, not by Vivitec.
• You can opt out at any time by replying STOP to any message from us. You will receive a confirmation, and you will not receive further messages under this program unless you opt in again.

• Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier network, device, and coverage, and we cannot guarantee that any message will arrive.
• Participation is subject to applicable laws, regulations, and wireless carrier requirements, and we may change or end the program at any time.
• No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile numbers, opt-in data, and consent records are handled as described in our Privacy Policy.

Our recommendations and quotes depend on what you tell us. You agree that the information you submit through our forms, configurator, and correspondence is accurate and that you have the right to share it.

You agree not to:

• Use the site in violation of any law or third-party right.
• Attempt to gain unauthorized access to our systems, accounts, or data.
• Probe, scan, overload, or disrupt the site or its infrastructure.
• Scrape or harvest content or contact data by automated means without our written permission.
• Submit malware, spam, or deliberately false or misleading information.
• Copy, resell, or redistribute our content or deliverables except as permitted below.

The site, its content, branding, and underlying software are owned by Vivitec or our licensors and are protected by intellectual property law. You may view and print pages for your own internal evaluation. All other rights are reserved.

Ownership of deliverables produced during a paid engagement is set by the agreement covering that engagement, not by these terms.

You keep ownership of the material you submit to us. You grant Vivitec a limited licence to use it for the purpose of responding to your request and delivering the services you asked for.

Our services involve AI systems whose outputs can be incomplete, outdated, or wrong. AI outputs, site content, and configurator estimates are informational and are not legal, financial, medical, or compliance advice. You are responsible for reviewing outputs and for decisions made in reliance on them, and you should obtain qualified professional advice where the stakes require it.

The site uses third-party services, including Stripe for payments, HighLevel (LeadConnector) for chat, Google Tag Manager for analytics, and Cloudflare for bot protection, and may link to sites we do not control. We are not responsible for the content, availability, or practices of third parties, and your use of them is governed by their terms.

Where you share non-public business information with us in the course of an inquiry or engagement, we will treat it as confidential and use it only to evaluate and deliver the services requested, except where disclosure is required by law.

We work to keep the site available but do not guarantee uninterrupted or error-free operation, and we may change or discontinue features at any time. Except as expressly stated, the site and its content are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Vivitec is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising from your use of the site or services. Our total liability for any claim relating to the site or services is limited to the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars if you paid nothing.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold Vivitec harmless from claims, damages, and reasonable legal costs arising out of your misuse of the site, your violation of these terms, or your infringement of a third-party right.

We may suspend or terminate access to the site or a plan if you breach these terms or if we reasonably believe your use creates risk or legal exposure. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, continue to apply.

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law rules. You and Vivitec agree to the exclusive jurisdiction of the state and federal courts located in Kentucky. Before filing, please contact us so we can try to resolve the matter directly.

We may update these terms as our services change. The effective date above shows the current version, and continued use of the site after an update means you accept the revised terms.
